I am on vacation today so will respond more tomorrow.
The oom-killer may be invoked if the balloon driver does
not have the balloon driver code fragment that limits
the minimum memory.

I'm not sure what you mean "in new version of patch".
The most recent patches in http://oss.oracle.com/projects/tmem/files/
(dated in 2010) do the shrinking in the kernel. (I should
remove all the 2009 patches as they are very outdated now.)
